Business Litigation

Barta Goldberg provides high-level legal counsel and representation to corporate and individual clients involved in a wide range of business litigation matters. Our engagements include disputes involving business ownership, breaches of contract, commercial torts including breach of fiduciary duty, fraud and misrepresentation, defamation, trademark and copyright infringement, misappropriation of trade secrets, unfair competition, and real estate matters including landlord-tenant and construction disputes.

Who We Represent

We represent individuals and business entities of varying sizes in commercial litigation matters involving the entertainment, media, real estate, restaurant and hospitality industries. Our clients include prominent entertainment agencies, real estate developers, restaurant chains, luxury hotels, actors, agents, writers, and entertainment business managers.

Superior Representation and What It Means

Since its inception in 1986, this firm has provided comprehensive litigation assistance to individual and corporate clients across many industries. With the retirement of both Howard Rosoff and Steven Schiffres and the emergence of Ashley Tate as an invaluable member of the firm, we have changed our name to Barta Goldberg, under which we continue to offer dynamic, aggressive and responsive solutions to our clients.

Sophisticated clients expect tailored advocacy and tireless attorneys who do not rest at any stage of litigation. We pride ourselves on our responsiveness. We foster and encourage direct client communication throughout our engagements, and our clients have come to expect a quick and professional response.

Representation of sophisticated clients in business litigation is often fundamentally complex. Our clients may have multiple and sometimes conflicting litigation and business objectives. We are trusted advisors and creative problem solvers, and obtaining a favorable litigation result is just the beginning.  We help our clients manage risk by incorporating our litigation strategies into their overall business strategies. When we represent clients, our team considers a multitude of strategies to achieve optimal outcomes and employs intensive risk assessment and cost-benefit modeling. In our experience, this approach best ensures a result that is of greatest benefit to the client and the client’s business objectives.

Litigation can significantly impact a client’s commercial interests, and as such, any truly comprehensive legal representation must consider a lawsuit’s business consequences. Narrowly focusing only on “winning” a dispute without broadly identifying and evaluating non-legal risks can jeopardize a client’s interests. Sometimes a quick resolution is the most sensible approach, and as such, developing creative pre-litigation solutions is central to our legal strategy.  For example, a drawn-out copyright dispute may not be sensible if the opposing party is willing to reach a reasonable pre-litigation compromise like a retroactive copyright licensing agreement. Ramping up hostilities may be entirely unnecessary, as it could not only increase the time, cost and effort required to successfully litigate the dispute, but could also seriously disrupt the client’s business.

Experience matters. Our attorneys have tried cases to verdict in state and federal courts, in bench and jury trials, arbitrations and appeals. We have served our clients at the highest levels of legal advocacy, including successfully representing their interests in the California Supreme Court and setting relevant legal precedent. Over the years, in handling the diverse concerns of our business litigation clients, we have accumulated tremendous insight into our approach to representation. Our attorneys have the broad expertise needed to effectively meet the complex and varied needs of every client.

And we are more than litigators. In fact, we regularly handle non-adversarial matters on behalf of our commercial clients, including transactional risk management, contract review and internal investigations. We act as general counsel, and as such, provide legal assistance through the lifetime of a claim: before a dispute arises, during litigation, and after the matter is resolved.

Big Picture Considerations

Our attorneys are committed to client-oriented legal services at competitive rates. Though litigation can be costly and time-consuming, we have the expertise and strategic mindset necessary to manage litigation expenses without sacrificing the quality of our representation.

At Barta Goldberg, we develop close relationships with clients that afford us deep insights into their needs, aspirations and limitations. All of these factors affect how we approach litigation. We are mindful of the financial burdens imposed on clients by lengthy disputes. When an opportunity to resolve a dispute early and favorably presents itself, we act decisively to secure results. Of course, when statement-making litigation is desired, we are ready and able to aggressively pursue a case all the way to trial and judgment.
